Understanding the Point System in NY Traffic Law

New York uses a point system to keep track of driving violations. Each time you get a ticket for breaking traffic laws, points are added to your driving record. Too many points can lead to fines, higher insurance rates, and even a suspended license. Understanding how this system works can help you avoid serious consequences and stay safe on the road.

How the Point System Works

When you are convicted of a traffic violation, the Department of Motor Vehicles (DMV) adds points to your record. The more serious the violation, the higher the points. For example:

  • Speeding 1–10 mph over the limit: 3 points
  • Speeding 21–30 mph over the limit: 6 points
  • Reckless driving: 5 points
  • Failing to stop for a school bus: 5 points
  • Using a cell phone while driving: 5 points

Consequences of Too Many Points

If you get 11 points within 18 months, your driver’s license may be suspended. Points are based on the date of the violation, not the date of conviction. This means multiple tickets close together can quickly add up and put your license at risk.

Driver Responsibility Assessment Fee

If you get 6 or more points in 18 months, you must pay a Driver Responsibility Assessment fee. This fee is separate from your ticket fines and is charged every year for three years. The more points you have, the higher the fee.

Reducing Points

You may be able to lower your total points by taking a DMV-approved Point and Insurance Reduction Program (PIRP) course. This course can remove up to 4 points from your record for suspension purposes and may also reduce your insurance rates. However, the points do not disappear completely — they are just not counted toward suspension.
